Penalties and enforcement From 1st October 2011, employers that provide workplace parking places may be subject to enforcement and penalties, listed below, if they do not comply with the WPL scheme. Civil Contraventions There are three types of civil contraventions: 1) Failure to have a licence at all It is the responsibility of each employer to get a licence for any workplace parking places that they provide. All workplace parking places must be registered by the 1st October 2011. Your first WPL licence will last for six months, from 1st October 2011 until 31st March 2012. Subsequent licences will last for twelve months from 1st April until 31st March each year. 2) Failure to have a licence for all workplace parking places being provided It is the responsibility of each employer to license the correct number of workplace parking places that they provide. 3) Breach of licence conditions Employers must comply with the WPL licence conditions [127kb]. If an employer commits one of the above civil contraventions they will be given the opportunity to remedy their contravention. However, continued non-compliance can result in a Penalty Charge Notice (PCN) being issued. Where any workplace parking is being provided at premises without a licence, or a licence covering all the workplace parking places, the PCN will be for 50% of the annual charge per unlicensed place for each day a contravention occurs. Civil contraventions will be enforced through PCNs, and may result in County Court judgments being issued against employers in cases of non-payment. -------------------------------------------------------------------------------- Criminal Offences There are two types of criminal offences in relation to the Workplace Parking Levy: 1) Intentionally providing false or misleading information Employers that deliberately submit false or misleading information in connection with an application (for example, in order to reduce or avoid paying a WPL charge) are committing a criminal offence. 2) Obstructing an officer's powers of entry Employers that refuse entry, obstruct, or prevent an authorised Nottingham City Council officer from entering their premises, at reasonable times for compliance purposes, are committing a criminal offence. We will attempt to contact you before beginning a compliance survey and will observe all necessary site procedures. We can also be accompanied by a member of your staff when conducting a site visit. Employers who commit criminal offences may be prosecuted in the Magistrates Court or the Crown Court, depending on the severity of the offence. The police may also carry out an investigation for fraud if false or misleading information is deliberately provided which may lead to a conviction resulting in an unlimited fine and/or term of imprisonment. -------------------------------------------------------------------------------- Compliance and Enforcement Compliance and enforcement checks will be carried out to ensure that employers have licensed and declared the correct number of workplace parking places and are complying with the conditions of the licence. These checks will be carried out at premises routinely, or where we believe breaches of the WPL scheme may be taking place.

The Workplace Parking Levy - Coming Soon The Workplace Parking Levy (WPL) will soon be introduced in Nottingham. Employers inside the Nottingham City Council administrative boundary will need to license any workplace parking places they provide, at no charge, from 1st October 2011. Employers with 10 or fewer workplace parking places will be entitled to a 100% discount and will not have to pay anything, although they will still need to get a licence. Employers with 11 or more workplace parking places will need to pay a charge from 1st April 2012. Information about the WPL has been sent out to employers as part of an ongoing communications campaign. The WPL - helping to improve public transport All money raised from the WPL must be invested into improving local transport for Nottingham. The Government has recently given the green light for two more tram lines (NET Phase Two) and the first phase of the station redevelopment (the Hub project) has already started. Both of these projects will benefit from WPL funding, with NET Phase Two taking the number of passenger journeys on the tram system up to an estimated 20 million a year. The WPL will also support the popular subsidised Link Bus network, which provides more than 6 million passenger journeys a year. The WPL and the benefits it will make possible will help to control the problems associated with traffic congestion, while promoting and encouraging the use of more sustainable, environmentally friendly forms of transport. Employers will be able to apply for a WPL licence online from 1st July via the WPL website. Paper copies will also be available on request.
